Interpretation

Words with the initial letter capitalized have meanings defined under the following conditions. These definitions shall have the same meaning regardless of whether they appear in the singular or plural.

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.

  • Third‐Party Social Media Service means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service.

User‐Generated Content (Job Posts, Comments, Images, and Videos)

  1. Job Postings: Our Service allows users to post job descriptions or related content. We are not responsible for the accuracy, legality, or reliability of such user‐generated content. We do not actively moderate or endorse user content.
  2. External Links in Job Posts: Some posts may include links to external websites. The Company does not control these links and is not responsible for any third‐party content, privacy policies, or practices. We encourage You to report malicious or inappropriate links so We may remove them.
  3. Rights to Remove or Restrict Content: If user‐generated content violates these Terms or is deemed harmful, fraudulent, or otherwise inappropriate, We reserve the right to remove such content without notice and may ban or suspend the user who posted it.
  4. Blog Comments: We may have a blog or community features that allow for user comments, including AI‐generated images. We reserve the right to remove comments containing harmful or inappropriate material and to ban users who violate these Terms or post objectionable content.
  5. Uploaded Images: Our Service may allow You to upload images (e.g., for job postings). Please note:
    • Public Access: Once uploaded, these images may be publicly accessible immediately (even if Your job post or draft has not yet been published). You understand that any uploaded image URL may be viewable by anyone with the direct link.
    • Copyright & Licensing: You represent and warrant that You own or have the necessary rights to upload any images to Our Service. If these images infringe third‐party rights (e.g., copyright, trademark, or privacy rights), We may remove or disable the images upon receiving a valid complaint.
    • Prohibited Content: You must not upload images that are unlawful, defamatory, pornographic, harassing, hateful, or otherwise violate these Terms. We reserve the right to remove or restrict access to such images at Our discretion.
    • Reporting Violations: If You believe an uploaded image violates intellectual property rights or is otherwise inappropriate, please contact Us at [email protected]. We will investigate and remove or disable access to the content if necessary.
  6. Embedded Videos (e.g., YouTube): If Our Service permits embedding of YouTube (or other platform) videos within job postings or other content:
    • Relevant and Appropriate: You agree only to embed videos that are relevant to Your job post or content and comply with Our Terms. Videos containing explicit, unlawful, or otherwise inappropriate material may be removed.
    • Compliance with Third-Party Policies: By embedding a YouTube video, You also agree to adhere to YouTube’s Terms of Service, Community Guidelines, and any other applicable policies.
    • Liability and Removal: We do not endorse the videos You embed. If an embedded video violates these Terms or any third‐party rights, We may remove the embedded content and take appropriate action against the posting user.

Refund Policy

When purchasing credits (or other paid services) on Our Service, You acknowledge and agree:

  1. No Guaranteed Results: While We strive to display job posts effectively (or provide relevant features), there may be outages, maintenance, or technical issues that impact the Service. You accept the risk that results may not meet Your expectations.
  2. No Refunds by Default: We maintain a no‐refund policy. However, We reserve the right, in Our sole discretion, to issue refunds on a case‐by‐case basis if a special circumstance warrants it.
  3. Service Obligations: If You have questions regarding Our obligations under these Terms (e.g., a paid feature not being fulfilled), please contact us at [email protected] before taking further action.

Links to Other Websites

Our Service may contain links to third‐party websites or services that are not owned or controlled by the Company.

  • The Company has no control over and assumes no responsibility for the content, privacy policies, or practices of any third‐party websites or services.
  • We strongly advise You to review the terms and conditions and privacy policies of any third‐party site You visit.

AI or Automated Features

  1. No Guarantee of Accuracy or Fitness: If Our Service uses AI or automated tools to generate text or images (including in our blog), such outputs can be inaccurate, incomplete, or unexpected. You acknowledge these limitations.
  2. Ownership/Usage: We assume no responsibility for legal or copyright implications of AI‐generated content. You use AI‐generated content at Your own risk.
  3. Limitation of Liability: The Company will not be liable for direct or indirect damages arising from AI‐generated outputs, to the fullest extent permitted by law.

Automated Crawling and Scraping

We reserve the right to block or otherwise restrict automated crawlers, scrapers, or bots that access our Service, especially if they consume excessive server resources or violate these Terms. Such blocking may occur without notice at Our sole discretion.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including (but not limited to) if You breach these Terms.

  • Upon termination, Your right to use the Service ceases immediately.
  • We reserve the right, at Our discretion, to remove or retain any job posts, comments, or user content You created if it contains harmful, explicit, or otherwise inappropriate material.
  • We may also ban users who violate these Terms from future use of the Service.

Limitation of Liability

  1. Maximum Liability: To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for special, incidental, indirect, or consequential damages (including, but not limited to, loss of profits, loss of data, or business interruption).
  2. Cap on Damages: The entire liability of the Company and its suppliers for any claim relating to the Service shall be limited to the lesser of:
    • The total fees paid by You through the Service in the past twelve (12) months, or
    • USD 100 if You have not purchased anything through the Service.
  3. No Liability for Content: The Company disclaims liability for any user‐generated job descriptions, blog content, or external links and the consequences of reliance on such content.
  4. State/Jurisdiction Variations: Some jurisdictions do not allow limitations on certain warranties or the exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to You.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” without warranty of any kind. To the fullest extent permitted under applicable law:

  • The Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‐infringement.
  • We do not warrant that the Service will (i) meet Your requirements, (ii) be uninterrupted or error‐free, or (iii) be accurate, reliable, or virus‐free.
  • Blog Content Disclaimer: Any blog articles, opinions, or advice shared by the Company or users are for informational purposes only and should not be considered official guidance, legal advice, or financial advice.

Some jurisdictions do not allow certain warranty exclusions or limitations, so these disclaimers may not apply to You fully.

Governing Law

The laws of Oregon, , excluding its conflicts of law rules, govern these Terms and Your use of the Service. Depending on Your location, You may also be subject to other local, state, national, or international laws.

  2. You are not listed on any U.S. government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held unenforceable or invalid, that provision is modified to accomplish its objectives to the fullest extent possible under applicable law, and the remaining provisions remain in full force and effect.

Waiver

The failure to exercise a right or require performance of an obligation under these Terms does not affect a party’s right to exercise that right or require performance at any time thereafter. A waiver of a breach is not a waiver of any subsequent breach.

Translation Interpretation

These Terms may have been translated if We made them available on Our Service in a language other than English. In the event of a dispute, the English version shall prevail.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. Any updates will be reflected in this section, and continued use of the Service after such modifications constitutes acceptance of the revised Terms.
